How Long Does It Take to Get a Verdict or a Settlement in an Accident or Injury Case?

There is no one answer to this question. Every case is unique and different. The final verdict or settlement obtained in a personal injury type case involves a number of dynamic factors. However, we work tirelessly to reach a conclusion to a client's case as quickly as possible so they are able to put the issue behind them and move on with life. If we are not able to fairly settle a personal injury case, we are fully prepared to go to trial and fight for what is fair and just for our clients.

Case Type: Wrongful Death 

Case Summary: In Portage County, Ohio, a man was employed at a laser-cutting company, and operated a complex machine used to cut steel.  One evening, while at work by himself, he became trapped inside the machine and suffocated.  His widow retained Slater & Zurz LLP Attorney Mark Ropchock to handle her wrongful death claim.  The insurance company contested complete liability, stating the client knew not to be inside of the machine.  Through diligent research and investigation, Attorney Mark Ropchock discovered the workers who had trained the deceased man informed him how to defeat the safety mechanisms of the laser-cutting machine.

Result: Attorney Mark Ropchock took the case to trial and was successful in obtaining a $3,000,000 verdict, including $1,000,000 in punitive damages.  

 

Case Type: Breach of Contract

Case Summary: In Monroe County, Ohio, an Insurance Company paid a commission to its sales representatives for each policy they sold.  Insurance Company paid commission again when the policy renewed.  Subsequently, the Insurance Company adopted a plan of unilaterally reducing those sales commissions for their sales representatives.  Slater & Zurz participated in the breach of contract action and represented about 170 agent-employees who were retroactively denied sales commissions by the Insurance Company.  Slater & Zurz filed suit on behalf of the employees and worked seamlessly through changes of venue, appeals to the Seventh District Court of Appeals and the Ohio Supreme Court. 

Result:  After being successful on a motion for summary judgment, the Insurance Company settled the claim for approximately 170 employees for $ 6,750,000.

 

Case Type:  Car Accident

Case Summary: In Hancock County, Ohio, our client, a 16 year-old boy, was involved in a serious car accident.  The car he was occupying was t-boned by another Driver, causing traumatic brain injuries and rendering him a quadriplegic. His family retained Attorney Jeffery V. Hawkins. The case was settled with the driver’s insurance company for the policy limit. However, after more investigation, Slater and Zurz determined that Client’s view was obstructed.  After making this discovery, Slater & Zurz sued the county, township and real estate owners.

Result:  Between the driver’s insurance policy and the lawsuit, Slater and Zurz recovered approximately $3,000,000 for our client.  

 

Case Type: Personal Injury - Auto Accident

Case Summary:  In Portage County, Ohio, a young woman was involved in a head-on collision with a dump truck.  She was transported by helicopter to a local trauma center where she was hospitalized for three weeks with injuries consisting of:  collapsed lung with insertion of chest tube, left mid-shaft femur fracture requiring surgery, left patellar fracture, right foot crush injury requiring surgery, ruptured Achilles tendon requiring surgery (and readmission for infection), and multiple rib fractures.  She retained attorney  John Lynett, Jr. of Slater & Zurz LLP shortly after the incident.  Her medical care lasted approximately one year and suit was filed in the Portage County Common Pleas Court. 

Result: Our client’s claim was settled at private mediation for just under $750,000. 

 

Case Type: Personal Injury - Auto Accident

Case Summary:  In Summit County, Ohio, a gentleman was headed home from work when his vehicle was struck head-on by a vehicle traveling the wrong way on a divided highway.  He sustained a fracture to his right leg and both arms were fractured requiring surgery.  Attorney John J. Lynett, Jr. of Slater & Zurz LLP diligently handled his case. 

Result:  After filing suit, our client obtained a settlement of $312,500.

 

Case Type: Personal Injury 

Case Summary: In Delaware County, Ohio, a 10 year-old boy was at a friend’s house. One of the homeowner’s children was playing with fireworks, and negligently set the 10 year-old boy on fire.  The homeowner’s insurance company contested complete liability - they claimed that the boy should have known fireworks were dangerous, and therefore the boy was comparatively negligent.  To battle the insurance company’s denials, Slater & Zurz diligently gathered and analyzed police and fire reports. 

ResultOur client’s claim against the insurance company was settled for $280,000

 

Case Type: Nursing Home Abuse and Malpractice

Case Summary: In Stark County, Ohio, an older man suffered a burst abdominal aortic aneurysm.  Although surgery was performed, he was left a paraplegic.  He was transferred to a nursing home for rehab, where he spent several months following the surgery.  After some time, he noticed a strange smell and complained to the staff and his physician.  His physician discovered a large decubitus, or bedsore on his buttocks. 

Result:  After the man retained Attorney John J. Lynett, Jr. of Slater and Zurz, a suit was filed and the case was ultimately settled for $75,000.

 

Case Type: Slip and Fall Accident

Case Summary: In Portage County, Ohio, A woman had stopped at a gas station.  As she walked around the back of her car to get to the pumps, she slipped and fell in an oily area on the ground.  She fractured her left elbow which required surgery and a course of physical therapy.  She hired John J. Lynett, Jr., of Slater and Zurz, who filed suit after the insurance company denied the claim. 

Result:  The case was ultimately settled by Attorney Lynett for $75,000.

 

Case Type: Car Accident (Uninsured Motorist)

Case Summary: In Summit County, Ohio, our client was retired, volunteering for charity and enjoyed working around the house.  While driving on a spring day, Client was hit head-on by an uninsured drunk driver.  Client sustained internal bleeding, multiple fractures, sleep deprivation, contusions and abrasions from the accident.  In bad faith, Insurance Company tried to persuade client to handle the claim without an attorney.  Skeptical of Insurance Company’s suggestion, Client contacted Slater & Zurz to handle the uninsured motorist claim.

Result: After addressing a potential bad-faith claim, Slater & Zurz took the Insurance Company to mediation, and got them to nearly double their initial settlement offer; Client’s case was settled for $ 217,500.

 

Case Type: Personal Injury (Auto Accident Involving Passenger)

Case Summary: In Stark County, Ohio, a gentleman was a passenger in a friend's vehicle. They were going fishing and decided to stop at a fast food restaurant on the way.  The driver made a left turn into the restaurant when his truck was struck on the passenger side by an oncoming vehicle traveling well in excess of the speed limit.  He incurred a variety of soft tissue injuries and was ultimately diagnosed with chronic pain syndrome.  He received treatment at a pain center where he received trigger point and spinal injections.  He retained attorney John J. Lynett, Jr., of Slater and Zurz. The insurance companies were not willing to negotiate a fair settlement.  

Result:  A lawsuit was filed, and after three days of trial, the jury returned a verdict of $130,000 against the driver of the speeding vehicle.  A verdict which, at the time, was the second highest personal injury verdict in Stark County.

 

Case Type: Personal Injury (Auto Accident)

Case Summary:  In Summit County, Ohio, a woman was stopped in traffic when her vehicle was rear-ended, causing crushing injuries to the back of both calves.  She required treatment in a local wound center consisting of debridement and skin grafts.  She was referred by her lawyer to attorney John J. Lynett, Jr., of Slater and Zurz. 

Result:  Attorney Lynett settled her claim prior to litigation for $160,000.

 

Case Type:  Dog Bite

Case Summary: In Stark County, Ohio, a seven year-old boy was at a friend’s house.  While playing there, the friend’s dog attacked the boy.  The dog bit off a portion of the tip of the boy’s nose, caused tissue loss and lacerations to the rest of the nose and inflicted bite-marks on the rest of the boy’s face.  The boy required the lacerations to be sutured, corrective skin-graft surgery and follow-up surgery to correct scarring.  The boy’s parents contacted Slater & Zurz, LLP, who helped manage the family’s grief and handled the difficult settlement negotiations. 

Result: Slater & Zurz analyzed all the variables, case law and medical bills and obtained a $230,000 settlement for the seven year-old boy and his family. 

 

Case Type: Wrongful Death

Case Summary: A man was killed in a traffic accident in Pennsylvania.  The mother of his two minor children contacted Attorney John J. Lynett, Jr., of Slater and Zurz, to represent them.  An estate was opened in Ohio to pursue the wrongful death claim. 

Result:  After a lengthy investigation, the claim was settled with the at-fault insurance company for the policy limits of $100,000.  The settlement was approved by the Stark County Ohio Probate Court and the settlement proceeds were placed into accounts for the children.

 

Case Type: Motorcycle Accident 

Case Summary: In Summit County, Ohio, a young man was riding his motorcycle home from work for lunch when a van pulled out in front of him at a stop sign.  He smashed into the side of the van, severely injuring both wrists in the process.  He required multiple surgeries to repair several broken bones in each wrist.  He retained attorney John J. Lynett, Jr., of Slater and Zurz, to represent him in his claim against the insurance company of the negligent van driver. 

Result:  The claim was settled for the insurance policy limits of over $100,000.

 

Case Type: Traumatic Stress Disorder

Case Summary:  In Cuyahoga County, Ohio, a mother saw her young daughter off for her first day of school.  At the end of the day, the mother was patiently waiting at the bus stop for her daughter to arrive back home.  Unfortunately, her daughter was nowhere to be found.  The bus driver shrugged-off the situation and drove away from the mother.  After the daughter was found, it was determined she was left on the bus.  Mother and her minor child both developed Post Traumatic Stress Disorder because of the incident.  Slater & Zurz was retained on behalf of both the mother and her child to sue the school district, who claimed immunity.

Result:  After filing suit, Slater & Zurz was successful at both the trial and appellate court levels.  They went on to settle for approximately $25,000 before the case reached the Ohio Supreme Court.

 

Case Type: Auto Accident (Driver and Passenger in Vehicle)

Case Summary: In Summit County, Ohio, an older gentleman and his friend were driving down the road in his van when a bread truck pulled out in front of them causing a collision that totaled the van.  They each retained John J. Lynett, Jr., of Slater and Zurz.  The driver fractured a cervical vertebra and had limited medical treatment.  The passenger sustained a head injury because he was not wearing a seatbelt, and also had limited medical treatment.

Results:  The driver’s claim was settled for $80,000.  The passenger’s claim was settled for $75,000.

 

Case Type: Auto Accident (Rear-Ended at Traffic Light)

Case Summary: In Mahoning County, Ohio a gentleman was stopped at a traffic light when his vehicle was rear ended.  He sustained low back injuries that ultimately resulted in a surgery.  His doctor referred him to attorney John J. Lynett, Jr., of Slater and Zurz, who filed suit on the claim. 

 

Result:  Following exhaustive discovery, Attorney Lynett was able to negotiate a settlement on his behalf of $75,000.

 

Case Type: Auto Accident Involving Elderly Woman

Case Summary: In Summit County, Ohio an elderly lady was involved in a motor vehicle accident that resulted in minor damage to her vehicle.  Unfortunately, she did not fare as well as the vehicle and was diagnosed with a cervical disc herniation.  She underwent neck surgery and a lengthy course of rehab.  Attorney John J. Result:  Attorney Lynett negotiated a policy limits settlement of $100,000 without the necessity of filing a lawsuit. 

 

Case Type: Car Accident

Case Summary: In Summit County, Ohio, A woman was broadsided in an intersection by a driver that failed to stop for a red light.  She received lacerations to her face and arms that resulted in scarring.  She retained John J. Lynett, Jr., of Slater & Zurz, because the insurance company was giving her a hard time with the property portion of her claim.  

Result:  Attorney Lynett resolved the property damage component of the woman’s claim, and the injury claim was settled for $90,000.

 

Case Type: Auto Accident ( Head-On Collision)

Case Summary: In Summit County, Ohio, a woman was driving to work when a car headed in the opposite direction crossed the center line and struck her vehicle head-on.  The collision destroyed her vehicle and broke both of her legs.  She hired John J. Lynett, Jr. of Slater & Zurz, to represent her against the insurance company that denied her claim.  Attorney Lynett filed suit and investigated the circumstances surrounding the accident.

Result: After thorough investigation, the claim was settled for the $100,000 insurance policy limits. 

 

Case Type: Auto Accident on Interstate

Case Summary: In Summit County, Ohio, a young woman was stopped in traffic on the interstate when her vehicle was struck from behind by another driver that was not paying attention to the traffic ahead of him.  She received an extensive course of conservative medical care, consisting of diagnostic radiology, chiropractic, physical therapy, medical management, and injections.  When there was no improvement to her condition, she was referred to a spine surgeon and a cervical decompression and fusion was performed. 

Result:  John J. Lynett, Jr., of Slater and Zurz, handled her case, filed suit, and settled her claim at court ordered mediation for $100,000. 

 

Case Type: Auto Accident Resulting in Injuries to Back, Neck, Shoulders and Wrist 

Case Summary: In Summit County, Ohio a man was operating his vehicle on a country highway when another vehicle ran a red light causing a t-bone collision in the intersection.  He suffered injuries to his neck, upper back, shoulders and left wrist.  He received a course of chiropractic care with referral to an MD for medical management and missed four days of work.  He retained Attorney John J. Lynett, Jr., of Slater and Zurz, who filed suit because the settlement offer was less than the medical bills. 

Result: The case was settled at court mandated mediation for $45,000.  

 

Case Type: Auto Accident (Ran a Red Light)

Case Summary: In Summit County, Ohio a woman was attempting a left turn on a green light when another vehicle ran the red light controlling his direction of travel and collided with her vehicle.  She hired John J. Lynett, Jr., of Slater and Zurz, shortly after the accident.  She received approximately eleven months of chiropractic care and was referred to an orthopedic surgeon who performed trigger point injections and epidural steroid injections.  Additionally, she lost months of wages as a result of the accident. 

Result:  Suit was filed and her case was settled at mediation for $50,000.

 

Case Type: Auto Accident Injuring Passenger of Vehicle

Case Summary: In Summit County, Ohio, a car was t-boned at an intersection on the passenger’s side.   The passenger was in the course and scope of employment and therefore, had both a workers' compensation claim and a personal injury / negligence claim.  She was treated and released at the emergency room, and received follow-up care from her primary care physician.  When conservative treatment failed, she was referred to an orthopedic surgeon who identified two cervical disc herniations.  She underwent a cervical decompression and fusion and ultimately returned to pre-accident medical status.  She retained John J. Lynett, Jr., of Slater and Zurz, to represent her because of the complexities of her injuries and medical care. 

Result:  During the course of litigation, her claim was settled for $125,000.

 

 

Case Type: Auto Accident Involving Elderly Woman 

Case Summary: In Summit County, Ohio an elderly woman was involved in a motor vehicle accident which aggravated a previously asymptomatic heart murmur.  She received a variety of cardiac care following the accident, although her cardiologist was unwilling to state that the car accident was the cause of her increased symptoms.  Her attorney referred her to John J. Lynett, Jr., of Slater and Zurz.

Result:  Attorney Lynett negotiated a settlement of her claim without litigation for $60,000.

 

Case Type: Auto Accident (Rear Ended at Stop Light)

Case Summary: In Summit County, Ohio a woman was stopped at a red light when she was rear ended by a moving van.  The accident caused only a small amount of damage to her vehicle.  She received chiropractic and medical care, but the radiating pain and numbness in her left leg persisted.  An MRI revealed a disk herniation at L5-S1 and she underwent low back surgery consisting of a micro-laminectomy and discectomy followed by a course of physical therapy.  She retained John J. Lynett, Jr., of Slater and Zurz because the insurance company had denied her injury claim due to the minor property damage involved in the accident.

Result:  A law suit was filed and, ultimately, her case was settled for $115,000. 

 

 

Case Type: Auto Accident Where Passenger Was Injured

 

Case Summary: In Summit COunty, Ohio,  an older woman was a passenger in a vehicle operated by her husband when it was struck from behind, forced into the cement barrier on the highway, and flipped onto its roof.  She was transported to the ER by ambulance and admitted for observation.  She followed up with her primary care physician and received approximately three months of physical therapy.  She was referred by her doctor to John J. Lynett, Jr., of Slater and Zurz.  The insurance company denied the majority of her care so a lawsuit was filed. 

Result:  Her claim settled at mediation for $35,000.

 

 

Case Type: Breach of Contract

Case Summary:  In Stark County, Ohio, a business client that is a large, local corporation, provided $ 431,341.20 worth of services to a company on credit.  When the company did not fulfill its payment obligations, the business client contacted Slater & Zurz to assist with collecting the outstanding balance and interest.  After consulting with business client, Slater & Zurz developed a strategy that involved suing company for a breach of their credit agreement. Slater & Zurz also made the strategic decision to file and unjust enrichment suit against another company that benefitted from the business client’s services.

Result:  After quickly filing a complaint and engaging in negotiations, the $431,341.20 was collected from the unjustly enriched defendant via settlement in less than thirty days.

 

Case Type: Breach of Contract

Case Summary:  In Cuyahoga County, Ohio, our client owned a snow removal service and had a contract to remove snow for a Major Company.  With approximately one year left on the original agreement, the Major Company decided to rebid their snow removal contract.  Client retained Slater & Zurz, LLP to handle the breach of contract claim.  The case was filed in Cuyahoga County and was removed to Federal Court, where Slater & Zurz vigorously litigated on Client’s behalf. 

Result The Major Company settled the case with our client for approximately $130,000.

 

Case Type: Personal Injury (Auto Accident)

Case Summary:  In Summit County, Ohio, a young woman was involved in a rear end collision that did minor property damage to her vehicle.  She experienced radiating pain and tingling into her arms and was ultimately diagnosed with a herniated disk in her neck.  Three years after the accident, she underwent a cervical fusion surgery and a lengthy course of rehabilitation. Result:  After a law suit was filed, Mr. Lynett obtained a settlement of over $100,000 for the young woman. 

 

Case Type: Auto Accdident (Passenger in a Car)

Case Summary: In Summit County, Ohio, a gentleman was a passenger with his mother when their vehicle was t-boned in an intersection and flipped onto its side.  His mother was cited for the accident.  He retained John J. Lynett, Jr., of Slater and Zurz to represent him because the insurance company for the other person in the accident blamed his mother for the accident.  The claim was investigated, witness statements were obtained and his mother was represented at the traffic trial.

Result:  His mother was found not guilty, and his injury claim was settled against the other insurance company for $82,500.

 

Case Type:  Auto Accident Involving High School Student

Case Summary: In Stark County, Ohio, a young man was involved in a motor vehicle accident that fractured his left femur.  His mother contacted John J. Lynett, Jr., of Slater and Zurz, to represent him.  He underwent surgery involving the placement of a rod in his femur.  Following a course of physical therapy, he was finally returned to pre-accident condition and was able to resume high school sports. 

Result:  His claim was settled for $85,000.

 

Case Type: Head On Auto Accident

Case Summary: In Summit County, Ohio, a man was involved in a head on motor vehicle accident.  He was referred by his lawyer to John J. Lynett, Jr., of Slater and Zurz.  The man suffered a neck injury in the accident, and following conservative medical care, surgery was recommended.  Due to a variety of other medical conditions, he elected not to receive the surgery.

Case Type: Foreclosure

Case Summary: A client located in Summit County, Ohio lost his job and struggled to find work.  He missed mortgage payments, and the bank began foreclosure procedures on his house.  The client had nowhere else to turn, and contacted Slater & Zurz.  After gathering client financial information and preparing a loan modification packet, Slater & Zurz took the bank to mediation.

Result:  We negotiated a modified payment plan and the client was able to keep his house.

 

Case Type: Employment Contract 

Case Summary: In Cuyahoga County, Ohio,  a client worked as a high-ranking salesman in a Company.  His employment contract contained a non-compete clause.  Client left his position at the Company, and to support his family, accepted employment at another corporation.  Duties at his new corporation caused Client to violate the non-compete clause with Company.  Company sued Client for breach of the non-compete clause, and sought Client’s severance pay and additional damages.  Client retained Slater & Zurz to help with his breach of non-compete issues.  Slater & Zurz diligently analyzed the facts and case law surrounding Client’s matter, and took the position that the non-compete was unduly burdensome and overbroad.

Result: Slater & Zurz went to mediation with Company and worked out an agreement to allow Client to keep working to support his family.
