The first step is to obtain the medical records. From there, the records are reviewed by a physician of our choice. And that physician normally will be able to tell us whether or not a case exists. We then analyze the facts that we see in the records. We analyze the opinions we receive from the physicians. And we decide if the case is worth pursuing.
If the case is worth pursuing, normally a complaint is filed in the jurisdiction in which the nursing home is located. And the case proceeds from there through the litigation process.
Nursing home victims are commonly an elderly person or a person who is disabled who is being taken care of by nursing aids, LPNs, RNs, and/or the nursing home physician. The common cases we see are nursing home residents who are not properly cared for in the sense that they're not hydrated properly. They're not cleaned properly. They're not medicated properly. Or they're not turned enough times so that bed sores develop.
It's difficult sometimes to analyze the records because the offending nurses or aids sometimes aren't very proficient in putting into the records the facts that we deem important to pursue a case.
Well, commonly a nursing home case, the negligence of the nursing home has resulted in the death of the resident. So the family will normally choose one of their own to become the estate representative and that representative will then work with us in pursuing the litigation against the offensing nursing home.
